Is Nvidia Running An Illegal Contest?

This is a link to a contest that the company is currently running. It offers their products FREE in a contest that says the traditional “No Purchase Necessary”.

In order to participate, you must download a small utility that scans your computer for their branded hardware. BUT, If you do NOT have their branded hardware you are refused entry.

In order to “qualify for entry” you must upgrade the components in your computer (the motherboard and the video card) to their branded hardware.

What does SLI-Ready mean?
An SLI-Ready PC is a PC built using an SLI-Ready NVIDIA nForce motherboard, and one SLI-Ready GeForce powered graphics card
What does SLI-enabled mean?
An SLI-enabled PC is a PC consisting of an SLI-Ready NVIDIA nForce motherboard and TWO SLI-Ready graphics cards.
How do I become SLI-Ready?
Simply visit the SLI Marketplace and we can help you either upgrade your current PC or purchase a new SLI-Ready PC.

I doubt there is anything wrong with nVidia targeting a product promotion at those who will be able to use said product if they win the lottery. If you do not have an SLI capable motherboard, with a single SLI video card already, a second SLI video card would be useless to you, or anyone else in similar circumstance. A large percentage of PC owners have no idea what kind of motherboard is in their computer, so nVidia has provided a utility that can be run to determine whether or not you can utilize the product which is the subject of the promotion, and a criteria for entry.

I don't mean to be unkind, but if you are pissed that you aren't able to base your next system/motherboard purchase on the outcome of the lottery for the SLI video card nVidia is promoting, you may have other issues which should be addressed before the mechanics/eligibility for this promotion. If you don't have a SLI capable MB, and are just looking for the chance to win something you can then resell, nVidia has predetermined you do NOT fall within its target demographic. I am sure they are well within their rights.

I agree with the original poster on this one, it seems pretty clear that a purchase IS required to qualify. I have no problem with this contest restricting itself to just those with the proper hardware, but if that is the case then they can not say "no purchase necessary"

I am not a lawyer, but this does seem suspect.

Edit: I don't think it is illegal for them to say one thing and have it be another, however it probably does open them up to the possibility of lawsuits from consumers who can't enter because they didn't make a purchase.

Seems to me this promotion is a targeted reward for previous purchasers of nVidia products intended to increase brand loyalty, NOT a solicitation to buy their hardware to the public at large. They provide a utility to check your status, and advise you if you qualify, or not. You are not forced to go out and buy nVidia equipment, but you may do so if you wish to participate in their lottery. Not dissimilar to lotteries that require you to be a resident of the state it is held in, as you may elect to move to the state to participate at your own expense, but no one is forcing you to do so.
