It is true and this is the WHOLE story:

The school has allowed anti-virus to expire and it is 6 months out of date. The school had also allowed its firewall to lapse and there was no filter software installed on the computer.

Substitute teacher was called in to teach a class. Regular school teacher logs into the computer using his user name and password since substitute does not have one and tells her: "Do not turn this computer off." Then regular teacher leaves.

Kids surf web a bit and get to site with hairstyles. Suddenly, porn ads start popping up and it's one of those close one window and 20 more porn ads open loops.

Teacher removes kids from vicinity of computer. She's not super computer literate and even a net admin can have trouble stopping one of those porn ad loops. Having been told she is not to turn the computer off, she doesn't. Instead she contacts school authorites.

Defense expert witnesses (computer security experts all) find 27 different malware programs on this computer, many of them having been installed before the teacher even taught the class. They have even recreated what happened by visiting the hairstyles site. As soon as they did, porn ads started popping up and it went into a porn ad loop.

Unfortunately, because the defense lawyer did not mention 'malware' in his disclosure, the prosecution argued that the defense expert witnesses should not be allowed to testify the judge agreed, and the teacher was found guilty and sentenced.

Luckily, she will appeal.

Imagine you are surfing the web and your kids are playing with some visiting friends. Suddenly, you go to a site and porn ads start popping up. You are able to stop them, but your kid's friends see the porn ads. You are now guilty of felony child endangerment and are open to going to jail just as she has.

I smell reversible error! Good thing, too, because the mere fact that a jury's decision was ridiculous and unsupported by the facts is not necessarily grounds for appeal.

If the PC was infected with spyware then let her go.

But I find it odd that her lawyers didn't bring it up in pre-trial. That makes you wonder if she even told them the computer had spyware.

Makes me wonder why she her self did'nt inform the school of the spyware problem (From what I have read her students told other teachers of the porn she never told the school what happened until after)

Just makes me wonder if they found spyware on her PC and decided to exploit the spyware issue, and any expert witness for the right amount of cash will say anything under oath.
