The matter is not if they win or lose, it is more bringing to attention how HARD the RIAA / MPAA has been on media distribution and other "companies" (legit or not) when it comes to their media. They are demanding more and more money per download, more and more protection, and making people wish that they would get out of the media distribution business all together.
We've seen them fight Apple tooth and nail when it comes to media downloads on their music. We've seen Microsoft patch their DRM on music downloads FASTER than their operating system. We've seen other media distribution companies have a hard time working out deals with the companies time and time again. It's almost like they don't want them to exist..... THEY were the only means of distribution, and that all other channels of media distribution were missing to improve revenue. When they do this (if they succeed) they will be making more money on their broken business model and ruining peoples rights with horrible senators like Warren Hatch (Utah), and Ted Stevens (Alaska).
I feel sorry for those artists and film makers that keep getting jipped by the media companies that have a virtual stranglehold on their profits and income. Don't want the money to go to them? Too bad! Want to start your own media company? Good luck, you don't have the cash or resources to get started!
It's a virtual oligopoly (sp) and the world knows it. Why do you think the RIAA hates indy bands and groups that are not going with their "get rich quick" mentality when they won't sign their songs rights away? It comes down to one thing and one thing alone M O N E Y.
The fact of this case is not a win / lose but instead a "wake up people and look at what the hell is going on with your digital rights".

Maybe you should be a PARENT to your children, rather than forcing the "village" to go without because of your unwillingness to do so.
Take their computers out of their bedrooms and put them in a family area where they can be watched. Don't give them administrative-level accounts so it's harder for them to install things. Take them away if they abuse the privilege. Geez.
"Burying" useful technologies because you have no control over your children seems a bit Draconian, don't you think? |

For the good of consumers and the U.S. populace in general, it would be great if limewire wins... So defeat is probably a certainty.

Limewire may or may not successfully defend itself on the copyright issues and charges it is aiding and abetting copyright infringement. The Grokster case revolved around a centralized directory and the fact that Grokster had control of it. That got them in trouble. Limewire claims it has no control at all over a centralized directory of any sort, therefore the Grokster ruling doesn't apply. The courts may not agree and may base their decision on INTENT of Limewire to aid and abet copyright infringement and not on any technical control issues. Facts submitted about their advertising methods may determine whether they win or lose.
As far as counter-suing claiming antitrust, they are on shaky grounds. Industry associations and trade groups like the RIAA have been found legal over and over in the courts as long as they didn't hold meetings to set prices or exclude companies in the industry from joining the trade group. Companies in the industry, in this case, comprising music companies that own copyrighted material. | reply to Josimars Every machine I get a call on to clean or repair has Limewire or eMule on it. Teens using it for getting music and apps. I even know a colleague that instead of getting a demo or buying something to use, goes to Limewire religiously. Asking for trouble. If anything, Limewire should sue for entrapment, service tampering (as I am 90% sure RIAA has someone uploading trojans as mp3 files).Songs shouldn't be executables. Can't blame the kids though. Many teens have no clue (look at study about remorse/consideration lacking in teen development) and just want peer acceptance. What I want to know is, how does Limewire make any money? Are they selling ads in their P2Pware? Or selling IP information? Yeah, goodluck LW. I wonder if they took the image for their logo from some pirated photo-clipart CD... |
