Just because they don't completely overwhelm the server doesn't mean it's not a distributed attack.
I think Lycos is going to make quite a few enemies that have quite a bit of money to invest in blackhat counterattacks.
Edit: Don't get me wrong I don't like spammers, but this is most likely doomed to backfire. |

You realise that there are hundreds of thousands of ppl - lets say 1 in 20 ppl who use the internet - i.e. 5% of the internet population that have no problem "stooping to their level" if it means destroying spammers.
if it meant all i had to do was snap the neck of one spammer for it to stop, i'd gladly do it to save the world billions of dollars. i'd even post my paypal id online to claim my winnings. |

The only reason that antispam legislation has gotten to the point that it has, (although it's still sorely lacking), both here in the US and most importantly, in the rest of the world (where spam is being outright banned), is because the battle has been fought without resorting to these tactics.
When spam first began showing up, if these tactics had been used, the outcry about "frea speach" and contitutional rights would have drowned out the message of the antispam community, namely the cost shifting and undue burden placed on recipients, as well as the server hijacking and out-and-out fraud perpetrated by these criminals. These outcrys, against of backdrop of abuse perpetrated by spammers and antispammers alike may well have elicited sympathy for the "legitmate bidness" of spam by our congress-critters.
As we have followed the letter of the law instead, and used a combination of technology, blacklisting, lawsuits and legislation, slowly but surely, these spammers are being backed into a corner where their tactics are morphing into bizarre caricatures of their former activities. They are resorting to blatant illegalities which is only accomplishing one thing, to bring even MORE light on their criminal activities.

It seems fair to me. They have caused me to abandon several e-mail accounts over the years, because they clog my inbox with junk e-mails (many from sites I would never dream of visiting).
They also send this junk to e-mail addresses of children. I say anything that puts these scum out of business is acceptable. |

From what I've read, there is no attempt to deny service access to anyone and in another posting I saw elsewhere, they attempt to minimize how much they slow a site down...
