| Customers Can't Sue Per Terms of Use/Service
CoNcast pulled a fast one. They took away their customers' rights to participate in any legal actions against them in one of the Terms of Use they added so quietly when they took over attbi's customers.
If that's not legally possible, they've pulled off one helluva bluff. The way it was presented was that I had to agree to their Terms on the spot or I'd be without connectivity and without my main email accounts on the spot.
They're not a fun company, but there are no other broadband options. Things went badly when I tried an SBC/PacBell DSL installation. The guy who came to the house spent 4 hours failing to make it work. He literally ran out before anyone could sit down at the computer and realize he lied when he said it finally did work. --mjz | |

| For the nth time!!!!!!!!!!!!!!!!! Comcast uses this as a network management tool! Live in an area where they have decent provisioning? Then download away, they aren't going to care. Live in an overloaded or poorly provisioned area? Then watch yourself.
Users have been getting kicked for for downloading as little as 30 gigs to +100 gigs. While others have proclaimed monthly averages of 50~+100 gigs without a peep from Comcast. Where that line is really depends on where you live and their network status as any given time. | |

What I've seen already is DSL providers using the cap denial as ammo. You'd think they'd just get over it, and post some reasonable friggin' caps. | Two quick things... well they've basically *SAID* what the limit is.. the limit is being one fo the top 0.5% of subscribers for a given period (assumably one month). Since that has nothing acually to do with how much *you* have downloaded and everything to do with how much everyone else has downloaded... they can't actually say what next months' limit is, cause they won't know till after its over an they go back and check everyone's statistics.
my real problem is the lack of an option of what you can do once they decide yer over this transient limit. Its one thing to say 'we're sorry, but you're really using more connection than everyone else in your tier.. for an extra $20 a month we can bump you up into the *REALLY* really unlimited tier and we'll shut up and let you do whatever you want.. it wouldn't be *great* but at least you could keep yer service and download 24/7 no worries)
Its another matter entirely so say 'you used more than we want you to, go away' especially after PROMISING you that they wouldn't put any limits on how you would use the service.
The huge problem with dsl is that the distance is at least in this current generation, totally unsurmountable... if you live too far, or have older phone equiment along the path to your home.. theres nothing that *you* can ever do to get service.. and unless you live much closer than average to yer local phone switch yer SEVERELY limited in speed right off the bat.. thats why DSL companies can't rib cable companies for limiting user's bandwidth.. cause DSL has the distance limit built inherent in the very technology of the system. | |
