I offer this counter-point. It is also not illegal to rape a being from another planet. They don't enjoy human rights because that only applies to a human from this planet.
That's a silly counterpoint, but they offer the same insight. Neither are illegal because up until it happens, nothing of the event ever existed. Kind of like "Methamphetamine" was not illegal when it was first created.
So I could offer then "I don't see why so many people took issue with raping women from planet XYZ, what they were doing was perfectly legal" or "I don't see why so many people took issue with me giving meth to my kids everyday, what I was doing was perfectly legal".
